Our Elder Law and Guardianship practice offers a full range of planning and litigation services and assists individuals and families with all issues involving the long-term care and support of the elderly and individuals with special needs, including:

  • Preparation and administration of Special Needs Trusts
  • Legal and financial planning for long-term care medical expenses, including qualification for public benefits such as Medicaid
  • Medicaid planning, including the preparation of Medicaid applications for individuals and couples and Medicaid appeals
  • Estate planning, including the preparation of wills, trusts, and powers of attorney
  • Preparation of Miller Trusts to aid in Medicaid eligibility
  • Assistance with coordination of geriatric care management
  • Guardianships of minors and incapacitated adults, including the creation and continuing administration of guardianships of the person and estate, court-created management trusts and guardianship litigation

Our Elder Law and Guardianship attorneys also represent clients in elder abuse cases, financial exploitation litigation and contested guardianship matters.

The team is led by Kelley Bentley, who is Board Certified in Estate Planning and Probate Law by the Texas Board of Legal Specialization. Ms. Bentley also is a Certified Elder Law Attorney (CELA) by the National Elder Law Foundation as well as an accredited VA Claims attorney. She is joined by T. Aaron Dobbs, who also is Board Certified in Estate Planning and Probate Law by the Texas Board of Legal Specialization.
